Terms of Service · Eipify Kids
Fair terms, in plain language.
These Terms explain the rules for using Eipify Kids: who can use it, how subscriptions work, and the promises we do and do not make. Like our Privacy Policy, they are written to be read.
§ 01 Agreement to these terms
Welcome to Eipify Kids. These Terms of Service (the “Terms”) are a legal agreement between you and Omar Abdulaziz (“we”, “us”), the independent developer and publisher of the Eipify Kids app (“Eipify”, “the app”).
By creating an account, subscribing, or otherwise using the app, you confirm that you have read and agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Eipify.
§ 02 Who may use Eipify
Eipify is designed for children, but the account must be created and managed by an adult. By using the app you confirm that you are at least 18 years old and that you are the parent or legal guardian of any child who uses it, or are otherwise legally responsible for that child.
You are responsible for supervising your child’s use of the app. A child may use Eipify only with your involvement and consent. If you do not meet these requirements, you may not use the app.
§ 03 Your account
To use Eipify you create an account with your email address and a password, and you set a parent PIN that protects the parent area. You are responsible for keeping your login details and PIN confidential, and for all activity that happens under your account.
Please provide accurate information when you sign up, and tell us promptly if you believe your account has been accessed without your permission. Eipify is intended for personal, family use. It is not licensed for classrooms, clinics, or organisations unless we agree otherwise in writing.
§ 04 Your licence to use the app
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use Eipify on devices you own or control, for your family’s own non-commercial use, subject to these Terms and to the rules of the Apple App Store and Google Play. We keep all rights that we do not expressly grant you here.
§ 05 Subscriptions and billing
Some features of Eipify require a paid subscription. Subscriptions are sold as auto-renewable in-app purchases and are billed through your Apple App Store or Google Play account.
- Renewal: Your subscription renews automatically at the end of each billing period (monthly or yearly, as shown at purchase) unless you cancel at least 24 hours before the period ends. Your store account is charged for the renewal within the 24 hours before the period ends.
- Managing and cancelling: You can view, manage, or cancel your subscription at any time in your Apple App Store or Google Play account settings. Cancelling stops the next renewal; it does not refund the current period.
- Free trial: If we offer a free trial, any unused portion is forfeited when you buy a subscription that covers that period.
- Price changes: We may change subscription prices. We will give notice as required by the stores and by applicable law, and any change applies from your next billing period.
- Refunds: Payments are processed by Apple and Google, and refunds are handled under their policies, not by us. Please contact Apple or Google for refund requests, except where the law of your country gives you additional rights.
§ 06 Eipify is not medical advice
Eipify is an educational and skill-building tool. It is not a medical device, and it is not a substitute for professional diagnosis, assessment, therapy, or treatment. The games, content, and progress information in the app are for general learning and family use only, and do not constitute medical, psychological, behavioural, or clinical advice.
We do not diagnose, treat, or guarantee any particular learning, developmental, or therapeutic outcome.
§ 07 Acceptable use
When using Eipify, you agree not to:
- use the app for anything unlawful, or in breach of these Terms or the store rules;
- copy, modify, translate, reverse engineer, decompile, or create derivative works from the app, except where the law expressly permits it;
- resell, rent, sublicense, or commercially exploit the app or its content;
- attempt to gain unauthorised access to our systems, to other users’ accounts, or to the backend, or interfere with the security or normal operation of the service;
- upload anything harmful, or use the app in a way that could damage, disable, or overburden it.
§ 08 Content and intellectual property
Eipify, including its games, text, graphics, audio, logos, and software, is owned by us or our licensors and is protected by intellectual-property laws. “Eipify” and our logos are our trademarks, and you may not use them without our written permission. These Terms do not transfer any ownership to you.
If you send us feedback or suggestions, we may use them freely to improve Eipify, without any obligation to you.
§ 09 App Store and Google Play
You download Eipify from the Apple App Store or Google Play, and your use is also subject to their terms. You acknowledge that:
- these Terms are between you and us only, and not with Apple or Google, who are not responsible for the app or its content;
- Apple and Google have no obligation to provide any maintenance or support for the app; we alone are responsible for support, as described in these Terms;
- if the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price to you; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the app;
- Apple and Google are not responsible for addressing any claims relating to the app, including product-liability, legal or regulatory, or intellectual-property claims;
- Apple, Google, and their subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
You also confirm that you are not located in a country subject to a relevant government embargo, and that you are not on any restricted-parties list.
§ 10 Privacy
Your privacy matters to us. Our Privacy Policy explains what information we collect and how we protect it, including how we handle children’s data. By using Eipify, you also agree to the Privacy Policy.
§ 11 Availability and changes to the app
We work to keep Eipify available and reliable, but we provide it on an ongoing basis and may update, change, suspend, or remove features from time to time, and we may stop offering the app or parts of it. We are not liable to you if the app is unavailable for any period. If we permanently discontinue a paid service, we will act fairly regarding any prepaid amounts, in line with the stores’ policies and applicable law.
§ 12 Disclaimer of warranties
Except where the law does not allow it, Eipify is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components, or that it will meet your expectations.
§ 13 Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of, or inability to use, Eipify. Our total liability to you for any claim relating to the app will not exceed the greater of the amount you paid us for the app in the 12 months before the claim, or a nominal amount permitted by law.
Nothing in these Terms limits any liability that cannot be limited under applicable law, or any mandatory consumer rights you have.
§ 14 Suspension and termination
You may stop using Eipify at any time and delete your account from the parent dashboard. We may suspend or end your access if you breach these Terms, if required by law, or to protect the service or other users. When your account ends, your licence to use the app ends, and we handle your data as described in the Privacy Policy.
§ 15 Changes to these terms
We may update these Terms as the app or the law changes. We will post the updated Terms here and change the “Last updated” date, and for significant changes we will give notice in the app. If you continue to use Eipify after the changes take effect, you accept the updated Terms.
§ 16 Governing law
These Terms are governed by the laws of the State of Qatar, without regard to conflict-of-law rules. If you use Eipify in Egypt or elsewhere, you may also have mandatory rights under your local consumer-protection laws, and nothing in these Terms takes those rights away. We would like to resolve any dispute with you informally where possible, so please contact us first.
